Introduction
Welcome to Kynetic Technology. These Terms and Conditions of Use (“Terms”) govern your access to and use of our services, including our customer acquisition pipelines, mobile applications, web applications, APIs, and associated engineering infrastructure (collectively, the “Services”). By accessing or using our Services, you agree to comply with and be bound by these Terms.
1. Use of Services
1.1 Eligibility: You must be at least 18 years old and possess the legal authority to enter into these Terms on behalf of yourself or an entity.
1.2 License & Ownership: We grant our clients full ownership of client-specific repositories, custom source code, schemas, and configurations upon project completion and settlement of applicable fees, with zero vendor lock-in.
1.3 Prohibited Activities: You agree not to use the Services for any unlawful purpose, violate intellectual property protections, or interfere with system operations.
2. Confidentiality & Intellectual Property
Both parties agree to treat all proprietary business plans, technical specifications, and customer databases as confidential information with strict non-disclosure obligations.
3. Warranties & Limitation of Liability
While we build applications according to industry-leading standards, services and deployments are provided on an “as is” basis. Kynetic Technology shall not be liable for indirect, incidental, or consequential damages arising from third-party hosting, DNS outages, or telecom service disruptions.
4. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, United States, without regard to conflict of law principles.
